TALEMARK TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of the Talemark mobile application and the connected services offered by Talemark.
Talemark is a film and book journaling platform where users can log the films they watch and the books they read, rate and review them, create lists and quotes, and interact with other users.
By creating an account on Talemark or using features that require acceptance of the Terms, you agree to be bound by these Terms. If you do not accept these Terms, you should not create an account or use Talemark.
The Privacy Policy and the KVKK Disclosure Notice provide information about the processing of your personal data; the acceptance of the Terms of Use does not mean that blanket explicit consent has been given through these documents. For optional processing that requires explicit consent, a separate choice is offered.
1. Provider of the service
Talemark is operated by the following person:

In these Terms, the expressions "Talemark", "we", "us" or "our" refer to the party that provides the Talemark service.
2. Scope of the Terms
These Terms cover the following:
- the Talemark Android mobile application,
- the Talemark account,
- the film and book journaling features,
- the profile, review, list, quote, comment, favorite and follow features,
- the notification, search, discover and recommendation functions,
- the support, report and moderation processes,
- connected features that Talemark may offer in the future.
Third-party websites, applications, film watch providers, book sellers or other external services are subject to their own terms.
3. Age and capacity to use
Talemark is designed for users aged 16 and over.
By creating an account, you represent that:
- you are at least 16 years old,
- you have the legal capacity necessary to use a digital service and to accept these Terms in the country you are in,
- you accept these Terms on your own behalf.
If the applicable age limit in the country you are in is higher, that limit applies. Since Talemark does not offer a dedicated system verifying the consent of a parent or legal guardian, persons below the required age limit should not create an account.
If we reasonably believe that the age condition is not met, we may restrict the account, request verification or close it.
4. Account creation and account security
To use some of Talemark's features, you need to create an account.
In relation to your account, you must:
- provide accurate and up-to-date information,
- use an email address that belongs to you and that you can access,
- ensure that your username does not infringe the rights of third parties,
- reasonably protect your sign-in credentials and your device,
- not transfer your account to another person or allow them to use it,
- notify us without delay of any suspicion of unauthorized access.
You are responsible for the transactions carried out through your account, to the extent that the unauthorized use does not result from Talemark's fault.
If a username impersonates another person, organization or brand; is misleading; infringes a right; or is objectionable in terms of system security, we may change the username, temporarily reserve it or restrict its use.
If you choose to sign in with Google, the security and access conditions relating to your Google account are additionally subject to Google's rules.
5. The service provided by Talemark
Talemark enables you to create your personal film and book journal and to benefit from community features. The features may include the following:
- logging films and books in the journal,
- marking works watched, read or to be consumed later,
- giving ratings and writing reviews,
- creating lists and adding list items,
- saving book quotes,
- using the favorite and follow features,
- discovering the public content of other users,
- keeping reading progress, goals and personal notes,
- viewing adaptation links and work information.
Talemark is offered free of charge and currently does not include in-app purchases or paid subscriptions.
We may add, change, redesign or remove certain features of the service. For significant changes that affect user rights, we try to provide reasonable prior notice.
6. User content
"User Content" means the reviews, comments, replies, lists, list descriptions, quotes, profile information, biography, images, ratings, favorites, journal entries, agenda notes and similar content that you add to Talemark or share through Talemark.
6.1 Ownership
Your existing intellectual property rights in your User Content belong to you. Talemark does not take ownership of your content.
Uploading content to Talemark means that the content belongs to you or that you have the necessary permission and legal authority to share the content.
6.2 Limited license granted to Talemark
When you upload User Content to Talemark, you grant Talemark a limited license with the following characteristics, solely so that we can provide the service:
- non-exclusive,
- royalty-free,
- valid in the countries where the service is technically provided,
- granting the right to host, store, back up, reproduce, convert into technical format and display within the application the content,
- sublicensable only to the extent that our service providers can carry out the necessary technical operations on behalf of Talemark
a permission to use.
This license does not grant the right to sell your content in independent advertising campaigns outside Talemark or to transfer it to third parties as commercial content.
For content you share publicly, the license also covers the display of the content in other users' feeds, on your profile, in lists, and in the search and discover areas.
When you delete the content or close your account, the license ends, except in the following limited cases:
- technical copies created before the deletion and held in the ordinary backup cycle,
- records that must be retained by law,
- limited records necessary for moderation, security or an ongoing dispute,
- copies or screenshots of the content independently taken by other users outside Talemark.
6.3 Responsibility arising from your content
You are responsible for ensuring that the content you share:
- is lawful,
- is attributed to the correct person,
- does not infringe the copyright, trademark, personality, privacy and other rights of third parties,
- does not unlawfully disclose confidential or personal information belonging to other persons.
Talemark is not obliged to review User Content before it is published. Nevertheless, we may take action regarding content upon notice, a report, an automated security signal or our own review.
7. Public and private areas
Talemark is a social platform. The following content may be public depending on the design of the relevant feature:
- username,
- profile photo and profile banner,
- biography and social links,
- reviews and ratings,
- public lists and list comments,
- quotes,
- favorites,
- follow and follower relationships.
The following information is presented as a private area unless otherwise clearly stated in the application:
- reading progress,
- reading goals,
- agenda and personal notes.
You should take into account that public content may be viewed, shared or screenshotted by other users.
Talemark may need limited access to data in private areas within the scope of security, support, moderation or legal obligations. This access must be limited to persons with the necessary authorization and to the relevant purpose.
8. Prohibited content and behavior
The following content and behavior are not permitted while using Talemark:
8.1 Security and unlawful activities
- conducting activities contrary to applicable legislation,
- inciting the commission of crime or sharing content obtained from crime,
- spreading malware, viruses, malicious code or deceptive links,
- attempting to gain unauthorized access to Talemark systems,
- circumventing security measures, access controls or rate limits,
- accessing other users' accounts,
- attempting reverse engineering, unauthorized vulnerability scanning or disruption of the service.
The rights of interoperability or security research expressly permitted by applicable law are reserved; if a security vulnerability is detected, it must be reported through support@talemark.app rather than exploited.
8.2 Behavior that harms the community
- threats, harassment, bullying or targeting,
- hate speech or degrading attacks based on protected characteristics,
- glorifying violence or calling for violence against real persons,
- sexual exploitation or content that endangers the safety of children,
- revenge-motivated intimate imagery or non-consensual sexual content,
- publishing another person's private information without permission,
- impersonating a person or organization,
- creating organized harassment, manipulation or fake engagement.
8.3 Spam and abuse of the platform
- repetitive, irrelevant or automated spam content,
- generating artificial followers, likes or engagement,
- opening numerous fake or misleading accounts,
- unauthorized commercial advertising, referral or bulk messaging,
- bulk scraping of data from the service with bots, crawlers or automation,
- systematically copying Talemark data to build a competing database,
- unauthorized or excessive use of the API, proxy or other technical resources.
8.4 Intellectual property and misleading content
- sharing someone else's work as if it were your own content,
- publishing a full book, film, screenplay or substantial amount of copyright-protected text,
- sharing long quotes that exceed lawful limits,
- creating the impression of a fake official account or verified account,
- sharing fraud, phishing or misleading links.
This list is illustrative. Other unlawful or harmful uses of the same nature are also prohibited.
9. Review, quote and copyright rules
Talemark enables users to share their original opinions about works and to save limited quotes from books.
9.1 Reviews
Your reviews:
- should as far as possible consist of your own expressions,
- must clearly indicate sections taken from another source,
- must not substitute for the whole or a substantial part of the work,
- must not copy other people's reviews without permission.
9.2 Book quotes
When adding a quote from a book, you must:
- keep the quote at a reasonable length for the purpose of assessment, criticism, discussion or personal record,
- indicate the work and author information where possible,
- not share full chapters, numerous consecutive pages or text of a scope that could affect the economic value of the work,
- not obtain content by circumventing access restrictions or digital protection measures.
The presence of the "quote" feature on Talemark does not mean that every added quote is automatically lawful. The user is responsible for the scope and use of the quote.
9.3 Notification of rights infringement
If you believe that a work or right belonging to you is being used on Talemark without permission, you can submit a notification to support@talemark.app together with the following:
- the name of the rights holder or authorized representative,
- the work or right alleged to be infringed,
- the link to the relevant content or profile on Talemark,
- a description of the request,
- contact information,
- reasonable information or documents showing your authority.
Manifestly incomplete, malicious or irrelevant requests may not be processed. Valid notifications may be reviewed; the content may be temporarily restricted, removed, or the user may be asked for an explanation.
10. Sources of film and book data
The film and book information shown on Talemark may consist of user content produced by Talemark and of third-party data sources.
10.1 TMDB
Film titles, posters, cast and crew information, summaries, ratings, release dates or similar film data may be provided through The Movie Database ("TMDB").
This product uses the TMDB API but is not endorsed or certified by TMDB.
The TMDB name, logos, data and images belong to the respective rights holders. Talemark's use of TMDB does not mean that TMDB endorses or approves Talemark.
10.2 Google Books
Book titles, authors, covers, descriptions, publication information or similar book data may be provided through the Google Books API.
Google Books and Google-related brand elements belong to the respective rights holders. Talemark does not guarantee that the data provided by Google Books is always complete, accurate or up to date.
10.3 Data accuracy
Third-party data may contain:
- incorrect or incomplete information,
- confusion between different editions,
- delayed updates,
- incorrect cover, date or person matching,
- service interruptions.
Talemark tries to provide reasonably accurate information but does not guarantee the accuracy or continuous availability of third-party sources. If you see incorrect data, you can use the reporting tools in the application or the support@talemark.app address.
11. Community guidelines, moderation and reports
The Talemark Community Guidelines, published alongside these Terms, explain in more detail the behavior accepted within the community and are part of these Terms.
Talemark may take action regarding content or an account for the following reasons:
- violation of these Terms or the Community Guidelines,
- contravention of applicable legislation,
- infringement of third-party rights,
- risk to the security of users or the platform,
- spam, manipulation or system abuse,
- a valid request from a court, administrative authority or competent institution.
The measures that may be applied may include the following:
- warning,
- reducing the visibility of the content,
- adding a spoiler or sensitive content tag,
- temporarily hiding the content,
- removing the content,
- temporary access restriction to certain features,
- temporarily suspending the account,
- permanently closing the account in the event of serious or repeated violations.
The type of action is determined taking into account the nature, severity and repetition of the violation, the risk it creates, the user's history and the necessary proportionality.
In situations such as an urgent security risk, the safety of children, a serious threat, fraud, a system attack or a clear unlawfulness, action may be applied without prior warning.
12. Appealing moderation decisions
If a moderation action is applied regarding your account or content, you may be informed of the basic reason for the action in situations where disclosure is not objectionable for legal or security reasons.
If you believe the decision is incorrect, you can apply through the appeal path in the application or to support@talemark.app within a reasonable period from the notification reaching you or from your learning of the decision.
In your appeal, you should state:
- your username,
- the relevant content or action information,
- why you think the decision is incorrect,
- any supporting information.
Appeals are, where possible, reviewed by an authorized person who did not make the initial decision or who can re-evaluate the decision. Talemark may revoke, change or uphold its decision.
Malicious, repetitive applications or applications intended to disrupt the system may be restricted.
13. Suspension and closure of the account
13.1 User deleting their account
You can delete your account at any time from within the application using the path:
Settings → Profile → Account → Delete Account
Account deletion cannot be undone. The scope of deleted data, backups and the limited records that may be legally retained are explained in the Privacy Policy and the KVKK Disclosure Notice.
13.2 Action taken by Talemark
We may temporarily restrict, suspend or close your account in the following situations:
- serious or repeated violation of these Terms or the Community Guidelines,
- risk to the security of other users,
- fake account, impersonation, spam or manipulation,
- an attack on system security or unauthorized access,
- a legally binding request,
- reasonable suspicion that the account has been compromised,
- failure to meet the required age limit.
To the extent possible and appropriate, the reason for the action and the appeal path are notified.
13.3 Consequences of closure
When the account is closed:
- your access to the service may end,
- your profile and content may be made invisible or deleted,
- limited records necessary for ongoing legal or security investigations may be kept,
- independent copies previously taken by other users may remain outside Talemark's control.
You may not create a new account to circumvent a sanction in place of a permanently closed account.
14. Notifications and electronic communication
Talemark may send the following types of communication:
- email verification,
- password reset,
- account security,
- significant changes to the Terms of Use or privacy documents,
- moderation actions,
- responses to user requests or support.
These are transactional communications that are part of the service and account security.
You can manage optional push notifications such as community interaction, follows, likes, comments or similar from the device and application settings.
Talemark currently does not intend to send commercial advertising or marketing emails. If marketing communication is offered in the future, a separate choice and opt-out option compliant with applicable legislation will be provided.
15. Rights belonging to Talemark
The Talemark software, interface, visual design, brand elements, logo, original texts, database structure and other content created by Talemark belong to Talemark or the relevant licensors.
Provided that you comply with these Terms, you are granted a right to use Talemark for personal purposes that is:
- limited,
- personal,
- non-exclusive,
- non-transferable,
- non-sublicensable,
- revocable.
This right does not authorize you to do the following:
- sell, rent or license the Talemark software,
- attempt to unlawfully extract the source code,
- use the brand, logo or designs without permission,
- copy the application or significant pieces of data,
- create the impression of an official partnership or endorsement on behalf of Talemark.
User Content and third-party data are outside the scope of Talemark's ownership claim in this section.
16. Suggestions and feedback
You can send suggestions, error reports or feedback about Talemark.
By sending feedback, you allow us to use this feedback, without any obligation to pay a fee, for the purpose of:
- evaluating the service,
- fixing errors,
- developing features,
- improving the user experience.
This provision does not permit the use of personal data you share with the feedback for purposes other than intended, or the free disclosure of information expressly marked as confidential.
17. Availability of the service
We try to provide Talemark in a reliable and secure manner. Nevertheless, interruptions or loss of features may occur in the following situations:
- maintenance and updates,
- third-party service interruptions,
- internet or device problems,
- security incidents,
- force majeure,
- legislative or competent authority requirements.
We do not guarantee that the service will be uninterrupted, error-free or continuously compatible with every device.
Where reasonably possible, we try to provide information about planned and significant interruptions.
18. Recommendations and content ranking
Talemark may make use of signals such as popularity, recency, follow relationships, user preferences or similar in order to make it easier for users to discover content.
Content ranking does not carry:
- a definitive judgment about the quality of a work,
- professional advice,
- the meaning that Talemark endorses the user's opinion.
Talemark's recommendations are offered solely to provide ease of discovery. You decide which film to watch, which book to read or which content to trust.
19. No warranty
Talemark is provided "as available", subject to the mandatory provisions of applicable law.
The following are not guaranteed:
- that the service will always be uninterrupted or error-free,
- that all content will be accurate, complete or up to date,
- that third-party links or providers will continuously function,
- that user content will be accurate or reliable,
- that the use of Talemark will provide a particular cultural, social or personal outcome.
This section does not eliminate consumer rights, security obligations or expressly given commitments that cannot be removed by law.
20. Limitations of liability
Talemark may be liable only for direct damages caused by its own fault and in a reasonably foreseeable manner, subject to the mandatory provisions of applicable law, intent, gross negligence, bodily harm and other liabilities that cannot be limited by law.
Talemark is not responsible for damages arising from the following situations outside its own control:
- unlawful or misleading content shared by a user,
- the behavior of other users,
- third-party services, links or data sources,
- the user's neglect of their account security,
- internet, device or operating system failures,
- force majeure and actions of competent authorities.
This section in no way eliminates:
- rights that cannot be removed by law,
- Talemark's obligations regarding the security of personal data,
- Talemark's liability arising from its own intent or gross negligence.
Because Talemark is offered free of charge, the free nature of the service may also be taken into account within the framework of applicable law when assessing liability; however, this does not eliminate mandatory rights.
21. Claims arising from the user's unlawful use
If a claim is directed against Talemark due to your User Content that violates these Terms or infringes the rights of third parties, we may contact you about the situation and request reasonable cooperation.
You are responsible for the consequences that arise from your own unlawful content or intentional abuse and that can legally be attributed to you.
This provision does not mean that you waive the mandatory rights you have as a consumer or that you assume Talemark's liability arising from its own fault.
22. Transfer or termination of the service
The operation of Talemark may be transferred to another person or organization within the scope of a restructuring, service transfer or legal transaction.
If such a change leads to a change in the data controller of personal data, the necessary information is provided in accordance with applicable legislation.
If we need to terminate the Talemark service entirely, we try to provide information a reasonable time in advance to the extent that there is no legal or security obstacle, and to provide an appropriate opportunity for users to export their data or delete their accounts.
23. Changes to the Terms
We may update these Terms for the following reasons:
- addition of new features,
- changes in security or abuse risks,
- changes in service providers or technical infrastructure,
- legal requirements,
- making the text clearer.
For significant changes:
- the last updated date and document version are changed,
- where appropriate, an in-app notification or email is sent,
- if the change requires new approval, separate acceptance is obtained from you.
We try not to apply material changes retroactively to the detriment of the user. If you do not accept the changes, you can delete your account and stop using the service.
Changes made to the Privacy Policy or the KVKK Disclosure Notice do not mean that automatic consent has been given to processing that requires explicit consent.
24. Governing law and disputes
These Terms are subject to the law of the Republic of Turkey, subject to the mandatory provisions of applicable local law.
In disputes, resolution is first encouraged through support@talemark.app.
If the dispute cannot be resolved, the competent and authorized court, enforcement office, consumer arbitration committee or other authority is determined in accordance with applicable legislation.
These Terms do not restrict:
- the right of the consumer to apply to the competent authorities in the consumer's place of residence,
- mandatory consumer protection provisions,
- the right to apply to the Personal Data Protection Authority regarding personal data.
25. Severability and non-waiver
If any provision of these Terms is found to be invalid or unenforceable, this does not affect the validity of the other provisions. The invalid provision is interpreted, to the extent permitted by law, with the valid provision closest to the original purpose.
Talemark's non-exercise of a right in a particular situation does not mean that it waives that right in the future.
26. Relationship between the documents
The following documents apply together in the use of Talemark:
- Terms of Use
- Community Guidelines
- Privacy Policy
- KVKK Disclosure Notice
- Separate explicit consent and choice documents offered for optional processing
In the event of a conflict between the Terms of Use and the Community Guidelines, the Terms of Use prevail with respect to the legal relationship; with respect to the processing of personal data, the Privacy Policy, the KVKK Disclosure Notice and applicable data protection legislation are taken as the basis.
27. Language
These Terms may be translated into different languages. In the event of a difference in meaning between the translations, the Turkish text is taken as the basis, subject to the mandatory provisions of local law.
